  • This is your residential rental agreement. It is a binding contract under the Residential Tenancies Act 1997 (the Act).
  • Parts A and B are the terms of your agreement. Part C is a summary of your rights and obligations.

Kindly be advised that this residential Rental agreement adheres to the guidelines outlined by Consumer Affairs Victoria. We strongly recommend reviewing the Special Conditions sections of this agreement, as they delineate the specific terms and conditions pertinent to Metro Student Accommodation.

9. Service of notices and other documents by electronic methods


  • Electronic service of documents must be in accordance with the requirements of the Electronic Transactions (Victoria) Act 2000.
  • The renter and rental provider must notify the other party in writing if they no longer wish to receive notices or other documents by electronic methods.
  • The renter and the rental provider must immediately notify the other party in writing if their contact details change.

10. Urgent repairs


  • The rental provider must ensure that the rental property is provided and maintained in good repair.
  • If there is a need for an urgent repair, the renter should notify the rental provider in writing via email, SMS or propertyme app.
  • Any plumbing issues and water leaks in your Room or Kitchen should be reported immediately. Failing to do so can result in notice to repair or breach of duty. ( Refer to 91zi section of the Residential Tenancy Act 1977 )

11. Professional cleaning


The rental provider must not require the renter to arrange professional cleaning or cleaning to a professional standard at the end of the tenancy, unless:

  • Professional cleaning or cleaning to a professional standard was carried out to the rented premises immediately before the start of the tenancy and the renter was advised that professional cleaning or cleaning to a professional standard had been carried out to those premises immediately before the start of the tenancy; or
  • Professional cleaning or cleaning to a professional standard is required to restore the rented premises to the same condition they were in immediately before the start of the tenancy, having regard to the condition report and taking into account fair wear and tear.

The renter must have all or part of the rented premises professionally cleaned or pay the cost of having all or part of the rented premises professionally cleaned, if professional cleaning becomes required to restore the premises to the condition they were in immediately before the start of the tenancy, having regard to the condition report and taking into account fair wear and tear.

12. Condition report


The renter/tenant will be given access to the condition report via propertme app on the date the renter/tenant moves into the rented premises.

Part B Safety-related activities


13. Electrical safety activities


  • The rental provider must ensure an electrical safety check is conducted every two years by a licensed or registered electrician of all electrical installations, appliances and fittings provided by a rental provider in the rented premises, and must provide the renter with the date of the most recent safety check, in writing, on request of the renter.
  • If an electrical safety check of the rented premises has not been conducted within the last two years at the time the renter occupies the premises, the rental provider must arrange an electrical safety check as soon as practicable.

14 Gas safety activities


This safety-related activity only applies if the rented premises contains any appliances, fixtures or fittings which use or supply gas.

  1. The rental provider must ensure a gas safety check is conducted every two years by a licensed or registered gas fitter of all gas installations and fittings in the rented premises and must provide the renter with the date of the most recent safety check, in writing, on request of the renter.
  2. If a gas safety check has not been conducted within the last two years at the time the renter occupies the premises, the rental provider must arrange a gas safety check as soon as practicable.

15. Smoke alarm safety activities


The rental provider must ensure that:

  • any smoke alarm is correctly installed and in working condition; and
  • any smoke alarm is tested according to the manufacturer instructions at least once every 12 months; and
  • the batteries in each smoke alarm are replaced as required.
  • The rental provider must immediately arrange for a smoke alarm to be repaired or replaced as an urgent repair if they are notified by the renter that it is not in working order.

Note: Repair or replacement of a hard-wired smoke alarm must be undertaken by a suitably qualified person.

    The rental provider, on or before the commencement of the agreement, must provide the renter with the following information in writing:
  • Information on how each smoke alarm in the rented premises operates; and
  • Information on how to test each smoke alarm in the rented premises; and
  • Information on the renter’s obligations to not tamper with any smoke alarms and to report if a smoke alarm in the rented premises is not in working order.
  • The renter must give written notice to the rental provider as soon as practicable after becoming aware that a smoke alarm in the rented premises is not in working order.

Note: Regulations made under the Building Act 1993 require smoke alarms to be installed in all residential buildings.

Part C – Rights and obligations

This is a summary of selected rights and obligations of renters and rental providers under the Residential Tenancies Act 1997 (the Act). Any reference to VCAT refers to the Victorian Civil and Administrative Tribunal.

Use of the premises

The Renter:


  • is entitled to quiet enjoyment of the premises. The rental provider may only enter the premises in accordance with the Act.
  • must not use the premises for illegal purposes.
  • must not cause a nuisance or interfere with the reasonable peace, comfort or privacy of neighbours.
  • must avoid damaging the premises and common areas. Common areas include hallways, kitchens, laundry and stairwells. Where damage occurs, the renter must notify the rental provider in writing.
  • must keep the premises reasonably clean.

Condition of the premises

The rental provider:


  • must ensure that the premises comply with the rental minimum standards, and is vacant and reasonably clean when the renter moves in.
  • must maintain the premises in good repair and in a fit condition for occupation.
  • agrees to do all the safety-related maintenance and repair activities set out in Part B of the agreement.

 

The renter:

  • must follow all safety-related activities set out in
    Part B of the agreement and not remove, deactivate or interfere with safety devices on the premises.

Modifications

The renter


  • may not make any modifications.

Repairs


  • Only a suitably qualified person must do repairs that are organised by management – both urgent and non-urgent.

Urgent repairs

Section 3(1) of the Act defines urgent repairs. Refer to the Consumer Affairs Victoria website for the full list of urgent repairs and for more information, visit www.consumer.vic.gov.au/urgentrepairs.

Urgent repairs include failure or breakdown of any essential service or appliance provided for hot water, cooking, heating or laundering supplied by the rental provider.

The rental provider must carry out urgent repairs after being notified.

Non-urgent repairs


  • The renter must notify the rental provider, in writing, as soon as practicable of:
  • damage to the premises.
  • breakdown of facilities, fixtures, furniture or equipment supplied by the rental provider.
  • The rental provider must carry out non-urgent repairs in reasonable time.
  • The renter can apply to VCAT for an order requiring the rental provider to do the repairs if the rental provider has not carried out the repairs within 14 days of receiving notice of the need for repair.

Assignment or sub-letting


The renter:

  • must not assign (transfer to another person) or sub-let the whole or any part of the premises.

The rental provider may give the renter notice to vacate if the renter assigns or sublets the premises without consent.

Rent


  • The rental provider must give the renter at least 60 days written notice of a proposed rent increase.
  • Rent cannot be increased more than once every
    12 months.
  • If the rental provider or agent does not provide a receipt for rent, the renter may request a receipt.
  • The rental provider must not increase the rent under a fixed-term agreement unless the agreement provides for an increase.

Access and entry


The rental provider may enter the premises:
  • at any time, if the renter has agreed within the last 7 days.
  • to do an inspection but not more than once every 6 months.
  • to comply with the rental provider’s duties under the Act.
  • to show the premises or conduct an open inspection to sell, rent or value the premises.
  • to take images or video for advertising a property that is for sale or rent.
  • if they believe the renter has failed to follow their duties under the Act.
  • to do a pre-termination inspection where the renter has applied to have the agreement terminated because of family violence or personal violence.
  • The renter must allow entry to the premises where the rental provider has followed proper procedure.
  • The renter is entitled to a set amount of compensation for each sales inspection.

Pets


Pets are prohibited on the premises.

SPECIAL CONDITIONS

These conditions are exclusively applicable to Metro Student Accommodation and are mandatory. Failure to adhere to these conditions may result in penalties or notice to vacate being enforced.


BREAKING LEASE


The tenant hereby agrees that if the property is vacated prior to the expiration of the lease the tenant shall be responsible for:

a) The rental for the rented property until it is re-letted to suitable tenants approved by the landlord.

b) Advertising of $462.00 which is incurred by management in order to re-let the property.

c) A re-letting fee equal to two weeks' rent.

BOND LODGEMENT


The tenant acknowledges that the bond paid under this tenancy agreement has been kept by the RBTA.

BOND REFUND


The tenant acknowledges having been advised that the refund of the bond at the end of the Tenancy can only be achieved by mutual agreement between the Tenant and the rental Provider.

BOND AS RENT


The tenant acknowledges that the Residential Tenancies Act 1997 provides a penalty of 10 penalty units ($1,000) if the tenant refuses to pay rent on “the grounds that the tenant intends to regard as rent paid by the bond or any part of the bond in respect of the rented premises

FIXED TERM TENANCY NOTICE


The tenant acknowledges the right of the landlord under the Residential Tenancies Act 1997 to issue a notice that will terminate the tenancy at the end of this fixed-term agreement. A minimum of 28 days' NOTICE in writing must be given by the tenant prior to vacating at the expiration of the lease or at any other time.

Warning if we do not receive 28 day notice will result in the forfeiture of your bond and other costs ( See Breaking Lease section )

MONTHLY TENANCY


At the conclusion of your lease agreement, you have the option to renew for an additional period of 3, 6, 9, or 12 months.

To exercise this option, you must provide a 28-day notice indicating your intention to extend the lease.

Failure to give notice will result in the lease converting to a periodic term, with a 7% increase in monthly rent.

MONTHLY TENANCY NOTICE

If you are on a monthly lease

A minimum of 28 days' NOTICE in writing must be given by the tenant prior to vacating.

Not adhering to this will result in the forfeiture of your bond.

LOCKS


Management acknowledges the tenant’s right to change the locks at the rental property providing management has been consulted and approved.

The tenant acknowledges that whilst all due care and attention has to be taken, Management cannot guarantee that all the keys to the property were returned by previous occupants.

NOISE

The tenant must not create any noise or behave in a manner likely to interfere with the peaceful enjoyment of other tenants. We request that the playing of music, musical instruments, video games and/or the television be kept to a minimum sound level and recommend the use of headphones. Breach notices will be issued to offending students. Any endangerment to another student or person or destructive behaviour will result in an IMMEDIATE NOTICE TO VACATE.

Kindly be advised that intermittent roof works are conducted for the repair and maintenance of air conditioners and other utilities located on the roof. During these instances, tenants on the second floor may unavoidably experience noise disturbances between the hours of 8 am and 4 pm. In such circumstances, tenants will receive prior notice of the scheduled works.


CONDITION REPORT


The tenant acknowledges that the Condition Report completed through propertyme app including photos, are provided herein at the beginning of the tenancy must be signed. This will be available to the tenant on request.

PROOF OF STUDENT ENROLMENT


This tenancy is subject to and conditional upon the tenant being enrolled in an approved Australian learning institution.  Proof of enrolment must be provided in the form of a valid student card or similar documentation upon request. Note the approved learning institutions will be contacted for verification

INVENTORY


This rental agreement is subject to and conditional upon the room being fully or partially furnished as per the inventory list attached to the condition report.Please ensure that all furnishings are maintained throughout the lease and returned in a similar condition allowing for fair wear and tear.

CONTENTS INSURANCE


It is not your landlord’s responsibility to insure your possessions. The landlord’s insurance policy covers only the building and the landlord’s furniture, fixtures and fittings. It is strongly recommended that you take out contents insurance cover to insure your personal belongings.

PICTURE HOOKS


The tenant shall not without the prior written consent of the landlord or management affix any rail, screw or fastening adhesive (including picture hooks) to the interior of the premises.

CARPETS


The tenant agrees to have the carpets professionally steam cleaned at their own expense when the property is vacated.

PETS

The tenant hereby agrees not to introduce any animal to reside at the property.


NUMBER OF OCCUPANTS


Use the premises as a residential dwelling for 1 person only per room. Due to Safety regulations, you will need to inform the management if you intend on having any overnight guests for longer than one night.  Approval must be obtained before any guests stay for longer than one night.  Additional costs will occur. Contact management to discuss costs.

USE OF COMMON AREAS & KITCHEN

As per your terms and conditions please note the following:-


  • The kitchen door is to be kept always closed. The Range hood is to be turned on when using the oven or hotplates. The range hood is to be switched off when finished.
  • Cooking is to be always supervised to avoid burning or scorching of cooking utensils and the risk of fire. Costs will be passed onto the offending person should this occur.
  • Hot food is to be placed on the provided cork matting to avoid damage to the kitchen bench surface.
  • You are required to clean all your own pots, pans, and utensils thoroughly when finished and store them in your assigned cupboard.
  • The cleaner will only be responsible for the general tidying up and cleaning up of the kitchen area. This does not include the washing and cleaning of all cooking equipment & utensils.
  • Camera surveil
  • lance will determine who is adhering to the above with the offending person being served a “notice of breach” and be issued with increased costs for cleaning and improper use of the kitchen area.
  • The storage cabinet assigned to your room is for personal appliances & utensils only and not for any food or consumption items to avoid contamination issues.
  • No food produce is to be left on the Kitchen floor. These will be disposed of immediately by cleaners. For example rice and flour bags or food containers.

FALSE FIRE ALARM AVOIDANCE


WARNING!!!!

  • WHEN USING THE BATHROOM AND SPECIFICALLY THE SHOWER, THE BATHROOM DOOR NEEDS TO BE SHUT AND THE LIGHT THAT ACTIVATES THE FAN BE SWITCHED ON ENABLING THE STEAM TO BE EXTRACTED.
  • ANY STEAM THAT FINDS ITS WAY INTO THE ROOM WILL SET OFF THE ALARM SYSTEM RESULTING IN FIRE BRIGADE ATTENDANCE AT A MINIMUM COST OF $5000.00 PAYABLE BY THE OFFENDING PERSON.
  • NO SMOKING OR VAPING IN ROOMS INCLUDING BATHROOMS.
  • NO BURNING OF CANDLES OR AROMATHERAPY TYPE PRODUCT IN ROOMS.
  • NO COOKING IN ROOMS, I.E MICROWAVES, TOASTERS, AIR FRYERS, PORTABLE COOK-TOPS ETC.
  • DO NOT TRY TO COVER THE FIRE ALARM FIXTURE THIS WILL RESULT IN BREACH NOTICE
  • NO ELECTRIC HEATERS WITH HEAT ELEMENTS EXPOSED ARE ALLOWED.

ELECTRICITY SUPPLY


Each room has its electricity meter.  You are responsible for the electricity bill. To get connected you can call Direct Connect on 1300 664 715.  Alternatively, you can call any electricity provider yourself.

INTERNET


Internet is currently free & unlimited. Fair use policy applies. Internet is provided within the room via an Ethernet wall socket. You will need to provide your own ethernet cable. If the student requires wifi they will need to purchase their own router. ELECTRIC POWERED VEHICLES RULES


The management and landlord strictly prohibit the storage or charging of electric vehicles, including scooters, hoverboards, or any other portable transportation devices, on the premises. These items pose a potential fire hazard, and the safety of all tenants is of utmost priority. Failure to comply with this directive may result in eviction and potential fines.

BATHROOMS RULES


The Tenant bears the responsibility of maintaining cleanliness in the bathroom, ensuring the absence of mold or visible soap scum.

Under no circumstances should the bathroom be utilised for laundry purposes. Specifically, washing clothes with buckets, portable washing machines, or any other method is strictly prohibited.

Showering is to be exclusively conducted within the designated shower area with the shower screen door closed. Additionally, the use of portable bidets, watering cans, or buckets is strictly forbidden.

When using the bathroom, especially the shower, it is imperative to close the bathroom door and activate the fan by turning on the light. This ensures effective extraction of steam preventing a false fire alarm.

NO MODIFICATIONS to the bathroom fixtures or plumbing is allowed

It is the Tenant's responsibility to report any plumbing or electrical issues.

PLEASE REPORT ANY LEAKS FROM TAPS, SHOWER HEADS, UNDER SINK AREA and TOILET Immediately to management.

PLEASE REPORT IMMEDIATELY any Broken Bathroom floor or shower tiles to management.

Failure to adhere to these rules may result in a notice to repair or breach of duty, as outlined in Section 91zi of the Residential Tenancy Act 1977, potentially leading to immediate eviction.

 

PARKING


Street parking is available on Ethel Grove and Home Street. Additionally, parking is permitted at the rear of the Shamrock Hotel.

Avoid parking in front of the Shamrock Hotel, as it poses the risk of fines and towing.

The rear lane of Metro Student Accommodation can be utilized for loading and unloading only. It must be kept clear at all times, and overnight parking is not allowed. Violations may result in fines and vehicle towing.

Please take note of all council parking signs before leaving your vehicle parked for a long period of time.

LAUNDRY


The laundry facility is situated on the ground floor near the kitchen.

There are two industrial washers and two industrial dryers available, all of which are coin-operated.

Please take note of the operating instructions and ensure compliance.

Kindly consider others waiting to use the service while using the machines.

Retrieve your clothes promptly to prevent them from being disposed of.

SECURITY & KEYS


There are 24 hour surveillance cameras in and outside of the building for your safety.

Each tenant is provided with security keys for all entry points to the building.

Ensure that doors are securely closed upon entering or leaving the premises.

Refrain from granting access to individuals, even if they claim to be tenants.

Personnel requiring access already possess their designated security keys.

If someone continues to want to enter the building , kindly instruct them to contact management.

If you notice suspicious activity inside or outside of the building please call police and management.

KEYS

You are given the following keys:

  • Room Key
  • LetterBox Key
  • Entrance Security key

Please keep your keys with you at all times to avoid being locked out the building.

IMPORTANT
If you loose your security key there will be a $70 replacement fee.

If you loose your room key there will be a $50 replacement fee

 

VACATING


When vacating Metro student accommodation, ensure the following steps are taken:

  1. Provide 28 days' notice to management, even if the agreement end date has been noted.
    If you're on a monthly rental, a 28-day notice is still required. Failure to comply may result in additional costs and the forfeiture of your bond.
  2. Thoroughly clean the bathrooms, removing any mold or soap scum. If you require professional cleaning services, contact management to arrange it at an agreed fee.
  3. Perform a steam clean on the carpet.
  4. Address any marks on the walls, using sugar soap for safe cleaning.
  5. Remove all personal belongings and dispose of any rubbish.
  6. Coordinate a final exit inspection with management to avoid any unforeseen issues.
  7. If you require the use of the Goods Lift please book a time with management prior to you vacating. The Goods lift can only be operated by management staff.
  8. Return all keys, including the entrance security key, to management either in person or at the student box on the ground floor. Do not hand over keys to other tenants on your behalf.
